The Law on Dog Bites
Strict liability:In California, the owner of a dog is liable for the damages suffered by a victim who is bitten by the dog, either in a public place or lawfully in a private place. This includes the dog owner’s premises. Contrary to popular belief, recovery for the victim does not require that the dog was vicious at some time prior to the present attack. Strict liability means just what it says: the owner is strictly liable for the injuries caused by his or her dog. There is no “one bite rule” in California, which means the owner is liable even the very first time the dog attacks someone.
The Dangerous Animal Rule: In California, a person who has control of an animal, even if he or she is not the animal’s owner, may also be liable for any injuries or damages it causes.
